The person granting the power is referred to as the ‘principal’ and the individual selected as the ‘agent’ or ‘attorney-in-fact’. The document is usually filled-in by both parties with the principal initialing next to every financial power that they decide to grant.
Once the form is completed and signed, usually in front of two (2) witnesses or a notary public, the form is to be kept by both parties. When the agent decides on using their right as the agent in the power of attorney the form is required to be presented with every action.
Durable Definition
The term ‘durable’ means the form remains valid EVEN IF the principal should become mentally incapacitated and no longer able to make decisions on their own.
