STATE DEFINITION

In West Virginia, a “Living will” means a living will existing and duly executed in accordance with the provisions of article thirty, chapter sixteen of this code and  “Medical power of attorney” means a power of attorney existing and duly executed in accordance with the provisions of article thirty, chapter sixteen of this code or existing and executed in accordance with the laws of another state. WV ST § 44A-1-4
