Download the Delaware last will and testament to plan for the event of your passing and letting your loved ones know of your desires as to who should receive your real and personal property.  This document if properly executed will be used by the probate court to make sure your wishes are carried out by the person you designate as your personal representative or executor.

STATE DEFINITION

In Delaware, “Every will, whether of personal or real estate, must be: (1) In writing and signed by the testator or by some person subscribing the testator’s name in the testator’s presence and by the testator’s express direction; and (2) Subject to § 1306 of this title, attested and subscribed in testator’s presence by 2 or more credible witnesses.” 12 Del.C. § 202
